Privacy and Policies

Section One: Introduction

• The Tukili application, represented by Jabal Thubair Limited (based in Mecca), always strives to maintain the privacy of personal data and complies with data protection and privacy laws. This is in regard to protecting users' personal data. The application management has formulated this policy, "Privacy Policy," to clarify the types of data collected about users and the purposes for which this data is used.

• Believing in the importance and confidentiality of data, and with the application management's commitment to providing the highest levels of service while ensuring the confidentiality and privacy of user data and input data, the management of the application is committed to maintaining the confidentiality and privacy of user information and materials entered by them as the basis of this privacy policy. The application management will not disclose such information except in accordance with the specific controls and provisions outlined in this policy.

• The term "data" refers to all information related to users of the Tukili application, including name, address, contact details, and any other data that identifies the user, as well as other data related to user activities through the application, data related to the devices used to access the application. This agreement is considered effective and binding as soon as the user agrees to it and begins the registration process with the application, in accordance with Articles Five and Ten of the Saudi Electronic Transactions Law. This introduction is an integral part of the Privacy Policy Agreement for the agent, so please read this policy carefully.

Section Two: Personal Data Collected by the Application

• The application collects the data provided by the principal (client) for registering an account on the application, which includes (first name, last name, email, country selection, mobile number).

• Data added by the principal (user) to their profile and the content they publish through the application.

• Data related to the principal (client) and the service description and client requirements provided to the agent before taking the step of intention and starting the service.

• Electronic payment data or bank transfer data provided by the principal (client) for the purpose of paying for the service (cost of the Umrah service), which is reserved with the application until the agent completes the Umrah.

• Service request data, including (request fee, principal's name, Umrah date, cost of performing Umrah, request opening date, request completion date).

• Data provided by the principal when reporting an issue with the application.

• Data provided by the principal when contacting the application or customer service for any reason.

• Data provided by the principal when evaluating the services received through the application.

• The principal (user) grants a non-exclusive, unlimited, and irrevocable license to use their personal information provided in the online registration form for the purposes of providing or updating services or notifying them about matters related to the application's services.

Section Three: Content

• The principal (client) provides content for messages, requests, and comments through the application at their own responsibility.

• The principal provides content for messages sent to the application to inquire about the content of services.

• The application collects data provided by the principal to report comments or issues that violate the terms and policies of the Tukili application.

Section Four: Contact Data

• The principal (client) provides their contact number and details when contacting us through the application, whether directly through the application, by email, or by phone.

• The principal can communicate with the application, in which case the client provides us with the following information: (name, email, subject of the message, content of the message).

• The application collects data provided by the principal while communicating with us to inquire about services or issues encountered while using the application.

Section Five: Cookie Policy

The Amomir application relies on cookie technology, which consists of small files stored on the hard drive of the principal’s (client’s) computer. When visiting certain web pages of the Tokili application, cookies identify the browser through a unique, random number without disclosing any personal information about the principal. Cookies help enhance the experience of using the application and identify the sections with the highest visit rates within the Tokili application.

Section Six: Purposes of Data Collection by the Application

• To register the principal's account with the application, enabling the application to use the various services and features it offers.

• To allow the principal (client) to communicate with the agent through the application to arrange for the performance of Umrah.

• To open and process orders through the application and complete them upon the agent's completion of the agreed-upon service.

• To collect data to enable the principal to pay for the service, follow up with the agent, and ensure the service is performed before the application transfers the agent’s dues.

• To address complaints from the principal, including reviewing the content of the provided service and all correspondence between the client and the agent.

• To enable the principal to add comments through the application.

• For documenting the contact information provided by the principal to the application and verifying its possession.

• To enable the principal to evaluate the services received through the application.

• To allow the principal to contact the application and respond to inquiries made through the application.

• For statistical purposes and internal application operations.

• For the implementation of regulations or decisions by public authorities.

Section Seven: Limits of Disclosure of Principal Data

• Disclosure of principal data to our partners in the application, employees, and workers for the purpose of executing services related to the Tokili application.

• Disclosure of principal data to comply with legal regulations and to execute judicial rulings and decisions by relevant authorities in the Kingdom.

• Disclosure of principal data to enforce the terms and conditions of the application and any other agreements between the application and the principal.

• Disclosure of principal data to entities that assist the application in providing services, such as electronic payment providers, for the purpose of verifying the accuracy of these transactions.

Section Eight: Data Storage

The application stores all principal data on fully protected and secure servers to safeguard the data from any breaches or hacking attempts. Data storage may require transferring data outside the Kingdom of Saudi Arabia if the application uses an external hosting service provider. Therefore, the principal authorizes the application to handle data with others and to transfer and store it on the servers it deals with.

Section Nine: Data Security

The application informs agents that the internet is not a 100% secure and reliable medium, so database breaches may occur despite the application taking proper measures to protect data. Out of respect for protecting agents' data, the application will notify them within three days of becoming aware of any breach.

Section Ten: Non-Disclosure Agreement

• The parties to this agreement (the principal and the agent) commit to maintaining the confidentiality and privacy of their personal data. They acknowledge and agree that any disclosure of personal data to the other party is at their own responsibility, without any intervention or liability from the application.

• The parties commit not to disclose any personal data while using the messaging feature within the application, and they are personally responsible for any such disclosure.

• The parties commit to keeping all data related to transaction details through the application confidential and not using it in any manner. They are contractually and legally responsible for any unauthorized or illegal use of this data.

• The parties undertake to keep the application's secrets and will be held accountable by the application for any breach of confidentiality of the site and its operations.

• The parties commit to refraining from disclosing any data related to the operation of the application to third parties, whether for compensation or not.

• The principal agrees to avoid using any means that would help collect data about other users, including their email addresses, phone numbers, and other contact details.

Section Eleven: Application Permissions Policies

The application obtains users' (principals and agents) locations to verify their country. If they are from Saudi Arabia, the application hides the option for the researcher’s account and only obtains the location from the agent when tracking the Umrah service each time. This is a mandatory feature as the principal cannot see the agent’s location. Therefore, the application requires the following:

• Permission for the agent to upload their ID card or change their profile picture.

• Permission for the agent to upload a photo of their hairstyle directly from the camera, as it is the last stage of Umrah rituals.

• Access to the microphone to allow users to send voice messages.

• Wake Lock permission to prevent the application from locking while performing Hajj or Umrah.

• Internet permission to allow the agent to upload their location data so the principal can track the steps the agent has completed in the rituals.

Section Twelve: Privacy Policy Modifications

The application reserves the right to modify this privacy policy at any time. Changes will be published within this document, and the application will send a general notification. Continued use of the application after policy modifications signifies the principal’s explicit acceptance of these changes. Therefore, please review this policy regularly.
